Auto Accident Injury Claim for More than Medical Bills?

by Gail
(New York, New York)

I was involved in a car accident in 2008 and I was the person who was injured. It's going to be 3 years in August, and I am still waiting for my settlement. I recently received information stating my medical bills were paid off.

I called my lawyer, and was told that we are still waiting for a trial date. My question is, should we be waiting for another trial if the insurance company paid off my medical bills? Thank You.

ANSWER for "Auto Accident Injury Claim for More than Medical Bills?":

It is not uncommon for your attorney to have negotiated with the insurer to have your medical bills paid while agreeing to contest additional matters. What your attorney did evidenced his shrewdness and expertise.

A good attorney is always thinking ahead; almost like a master chess player. Keeping the doctors and other creditors happy shows your attorney was taking action to insulate and protect you from repeated medical bills, past due notices and more. In addition your attorney knows she may have to rely on the same physicians to testify if your case finally comes to trial.

Skilled attorneys are sometimes able to convince a Claims Adjuster to accept limited liability and pay the medical bills while the case is pending. The rest of the case and possible monetary award is still very active.

In New York especially, it can take months and even years to finally get to trial. From the limited facts you present it appears your attorney is doing an excellent job. Try not to be frustrated with the time element. You will soon have your day in court.

Best of luck,

Judge Calisi
