Burned by Boiling Hot Water...

by Shea

This happened 30 years ago so this could be a moot subject. I was burned when I was 14 years old at a Howard Johnson Restaurant off the Pennsylvania Turnpike. My sister and I had gone in to a HJ to get some hot tea while traveling to the beach from West Virginia.

We went to the hot water dispenser and put the water in a foam cup and went back to the car. I got in the back seat and my dad pulled away and the cup of hot tea poured in to my shoe and took several layers of skin off.

Emergency vehicles were dispatched and they took me to the local emergency room for care. It took more than several weeks to heal. I know this sounds crazy but just curious if anything can be done 30 years later?

ANSWER for "Burned by Boiling Hot Water":

Well for starters, there is no statute of limitations for injuries that occur to a minor so the fact that you were 14 indicates that there is no applicable statute of limitations.

A more core issue will be proving up this injury after so many years. For example, finding an incident report, locating medical records and ascertaining ownership after 30 years, for example. These are all pieces of documentary evidence you would need in order to establish a claim and the fact that it is so old, this may be difficult to do.

The above is general information. Laws change frequently, and across jurisdictions. You should get a personalized case evaluation from an attorney licensed in your state. Find a local attorney to give you a free case review here, or call (888) 647-2490.

Best of luck,
