Can I reopen this case after a year?

by Johanna

I was bitten by my grandmother's dog about a year ago and had gotten stitches. It was on the inside of my lip and it had healed up pretty nicely... so I thought anyway. I have recently found that it's a bit swollen and I'm tasting a bit of blood. So I'm curious: Is it possible for to reopen this case?

ANSWER for "Can I reopen this case after a year?":

Johanna (Ohio):

If you've already settled your injury case with your grandmother's homeowners insurance company, and as part of your settlement you signed a release, then you have no further legal recourse.

In the alternative, if you didn't settle the case and never signed a release, you do have legal recourse. The State of Ohio has a two year statute of limitations. During that time (2 years) an injured victim can either settle their personal injury claim or file a lawsuit.

If you haven't settled your injury claim and you are still within the two year statute of limitations, ask your grandmother for the contact information for her homeowners insurance company.

Contact the insurance company and file an injury claim. Be sure to gather all your medical records, including medical bills, doctors narratives, and any other information related to your injury. The insurance company will need that information to settle your claim.

The above is general information. Laws change frequently, and across jurisdictions. You should get a personalized case evaluation from an attorney licensed in your state. Find a local attorney to give you a free case review here, or call (888) 647-2490.

Best of luck,
