Car Crash on Private Property…

I was driving on someone’s private property and crashed my car. Since the accident happened on their property, can I file a personal injury claim or lawsuit against them if I got hurt in the crash?

You probably do not have much of a claim against the homeowner unless there was something on the property which may have caused the collision. Even if there was something on the property which might have caused the collision, if you were not on the property with the homeowner’s consent your case will quickly evaporate.

If people were permitted to file claims against homeowners any time they crashed on their property there would be a deluge of crashes. It would be an excellent way for people to make money doing nothing but crashing their car onto private property.

You can certainly try to file a claim. There isn’t any law which precludes you from doing so. To do that you would have to contact the homeowner and get the name of their homeowners insurance company. That won’t be an easy task.

Your alternative would be to file a lawsuit against the homeowner. Doing so would probably be a futile endeavor as well.
