Child Almost Dies When Strangled in Pickup Truck Window...
(Hamilton, Montana, USA)
On November 11, 2011, at 5:00pm, our 2 year old grandson was strangled in my husband's pickup truck window. With no heartbeat or breath, my frantic husband performed CPR and got a faint pulse. With the EMT's and Ambulance, our local hospital ER, a Life Flight Helicopter 45 miles to a second hospital, and several days in a coma, our little guy survived.
We never want another family to go through what our family or our grandson has had to. More than 35 children die each year in these terrible accidents.
I want to wake the car companies up. I want Congress to write a piece of legislation to force car companies to install the $6.00 part in each window that will stop it if an obstruction is detected, like a small child, a human being.
This is so important that I'm willing to use every moment of time I have to work to get legislation passed and force this safety measure in every car and truck made or used in America. I understand Lexus has had these fail safe windows for years.
I also want to sue the pickup truck manufacturer for the damage and stress our family has faced. My daughter and her fiancee were saying their marriage vows in Hawaii at the time of the accident. Flying 3,000 miles home to a Childrens' ICU wasn't a walk in the park for her either.
What's the best way to get legislation passed to prevent this from happening again? Also, how do we go about suing the vehicle manufacturer for the medical costs and pain and suffering this ordeal has caused? Thank you.

Barbara, (Hamilton, Montana, USA):
The fastest and most reliable manner in which to create and pass federal legislation is to contact your congressperson. That is where new federal law begins...in the United States Congress.
Get your Congressperson's mailing and email addresses. Get as many other of the congressperson's constituency to begin a writing campaign. The more letters and emails the better.
You are the leader. Therefore you will have to use your resources to communicate your idea to as many of your congressperson's constituents as possible.
Prepare a pamphlet or other brochure for the constituents. In it make your case. Be as articulate as you have been in this set of facts. In the pamphlet or brochure suggest the words and phrases you want them to use when contacting the Congressperson.
That is how things get done in the US Congress. Of course if at the same time you were running your campaign you happen to contribute to your congressperson's campaign fund, that probably wouldn't hurt either.
The above is general information. Laws change frequently, and across jurisdictions. You should get a personalized case evaluation from an attorney licensed in your state. Find a local attorney to give you a free case review here, or call (888) 647-2490.
