Forced to see a new doctor?

I am a maid, was injured at work when a wheel fell of my cart on 7/20/13. I was injured before in the same places (neck and lower back) in September 2005. On 7/26/2013 I saw my family doctor. X-rays were taken and medicine was given to reduce the inflamed area. I was no better by the end of a week so my doctor ordered an MRI.

Workman's comp asked the hospital for my MRI records and received them. On 8/12/13 I was talking to my claims rep about my doctor appointment on Wednesday. She informed me that there weren't any major broken bones nor cracks that she could see, just normal wear and tear.

I was surprised that she revealed that information to me. At this time I was informed they were sending me to a doctor in Butte, and she would be my caretaker from now on. My question is if it's legal for them to make me leave my doctor to one they pick? What are the rules about getting treatment with workers comp? Thanks.

As the victim of a work related accident you have the right to choose at least one doctor from the workers compensation insurance company's list of company approved doctors. You apparently already did that.

From the facts, it appears the workers comp representative is looking out for your best interests. Your treating doctors had an MRI (magnetic resonance imaging) examination administered to you. It apparently revealed no work related injuries. As a result, the workers compensation insurance company could have denied further treatment. Instead, they seem to be on your side. Instead of ending your treatment, they are sending you to another doctor in Butte.

It's certainly legal for the workers compensation insurance company to make sure you have every advantage in the diagnosis of your injuries. Hopefully the new doctor will be able to find the basis of your pain and find a may to treat it.
