My son was working in a Gas Station and he was closing up for the night. He was alone and a robber was hiding and hit him on his head with a sledge hammer twice. Somehow he overpowered the assailant and called the Police.
Police came and admitted my son to the Hospital. He had a surgery straight away and was in the ICU for three days. He was discharged after 2 weeks. He has a plate placed inside his head, 37 stitches across his head, and a big scar on the left side of his Forehead, he has to live with all these for the rest of his life.
The company took him back to work after giving him leave of 1 month. They never cared for him or gave him any benefits. They began to harass him even by not giving him a chair to sit while on work and finally terminated him. Since then he is jobless.
It is almost six months now. He has occasional headaches, he cannot go inside a chiller and extreme cold climate makes his head numb. He has psychological problems when he is alone, paranoid that someone is waiting to attack him. Also, the after effects of head injuries are slow to show up and sometimes don’t show until much later.
Recently he applied for a job with a star hotel. They accepted his resume and experience and he was called for Interview. But he was rejected due to the scar on his forehead. (It was a high paying job in which he has 5yrs experience).
He is very young, married with a 2 1/2 yr old son. His career and life are at stake now. We have filed a suit. I expect my son to get what American law entitles him to get. Do you think he has a case? Thank You.
