Hit By a Truck in a Parking Lot...
(Lake County, IL)
I was walking and was hit by a truck in a parking lot where I work. I was clocked out of work when I was hit. I did not have car insurance at the time, and the guy who hit me has a $100,000 cap on his insurance. My medical bills exceed that cap.
Can I file a personal injury claim on the property owner's insurance for poor functionality of the parking lot, lighting, etc? Is there any other party I can pursue for compensation to pay my medical bills? Thank you.

You can always attempt to file a claim with the owners and management of the parking lot. To begin down that road you will probably need the assistance of a personal injury attorney. Personal injury attorneys have the benefit of subpoena power, litigation and pre-trial discovery. They can usually secure information you never could.
You may have 2 claims. One might be against the property owner and the other against the property manager. There may be an issue with lighting and security. A lot will depend upon the existence of previous claims of injuries resulting from poor lighting or other similar deficiencies.
The first thing you should do is to seek the advice and counsel of a personal injury attorney. You have nothing to lose and everything to gain if you do. If there is a case, a good personal injury attorney will be able to assist you with the pursuit of your claim. Most personal injury attorneys will not charge any fee for an initial office consultation.
The above is general information. Laws change frequently, and across jurisdictions. You should get a personalized case evaluation from an attorney licensed in your state. Find a local attorney to give you a free case review here, or call (888) 647-2490.
