How much is a broken wrist settlement worth?

by Irene
(Fontana, CA)

I was walking up the stairs with two bowls of oatmeal in my hands and my landlord's dog ran between my feet and caused me to fall. I hit my head and was given a cat scan at the emergency room, I had a broken right wrist, sprained left wrist and bruising. I received approximately 30 sessions of physical therapy and my range of motion is 45-50 degrees.

How much would this be worth? Should I sue the landlord since it was his dog? Thanks.

ANSWER for "How much is a broken wrist settlement worth?":

Your situation is very difficult from a dog bite scenario, for example which requires knowledge of dangerous propensity in some states and a "one-bite" rule in other states.

In your case, there is really no way for the landlord to predict that his dog might run past you and cause you to fall. Therefore, it is entirely likely that there is no liability here but rather, a freak accident for which no liability may flow.

Now, there may be medical provisions in the landlord or property owners insurance policy that allow your medical bills to be paid. You will need to submit a claim to the insurance carrier to see if they do, however.

The above is general information. Laws change frequently, and across jurisdictions. You should get a personalized case evaluation from an attorney licensed in your state. Find a local attorney to give you a free case review here, or call (888) 647-2490.
