Injury at a Nightclub...

by Maya

I was at a nightclub the other night and a fight broke out. People threw glass containers everywhere and I ended up with a gash on my leg. I went to the emergency room and had to get staples for the wound.

My question is, can I send the medical bill to the owner of the club since it happened on his property? Thanks.

ANSWER for "Injury at a Nightclub...":

Maya (California):

You can send the bill to the nightclub owner, as she is probably insured for just these types of events. But you mentioned "People threw glass containers everywhere...". If you were one of those "people," your chance of convincing the owner of the club or her insurance company to pay any of your bills is remote at best.

If you were even tangentially involved your actions may be considered contributory, and as a result any claim you might make will probably be unequivocally dismissed.

If you were in any way involved in the melee you could possibly be liable for paying some of the damages the club owner incurred. If the club owner makes a claim on her insurance policy and is paid for the damages she incurred the insurance company may decide to "subrogate". Subrogation is an action an insurance company takes after paying a claim to seek reimbursement from those who caused the damage.

The above is general information. Laws change frequently, and across jurisdictions. You should get a personalized case evaluation from an attorney licensed in your state. Find a local attorney to give you a free case review here, or call (888) 647-2490.

Best of luck,
