Injury from Fall in Church Parking Lot...

by Susan
(Lynchburg, VA)

I was walking down to the bottom parking lot of my church when I felt something grab my shoe. I started to fall and tried to catch myself, but ended up with a dislocated wrist, broken hand and several shattered bones in my fingers. I had surgery but my hand is still messed up.

Can I get compensation for my injuries from the church since it happened in their parking lot?

ANSWER for "Injury from Fall in Church Parking Lot...":

Susan (Lynchburg, VA):

You have a good chance of recovering compensation from the church. To do so you must first know what your diagnosis is and what the prognosis for your continued care will be.

If the church carries insurance and the parking lot is part of their property, contact a church senior and ask for the name and telephone of their insurance company.

Remember, if the church does have insurance you are not suing the church. You are merely asking their insurance company to reimburse you for your injuries, treatment, costs, and pain and suffering.

Another way to look at the issue is this: The church purchased liability insurance to protect themselves if someone was injured. In other words they purchased it to cover incidents just like yours.

Call the church’s insurance company. Tell them you want to file a personal injury claim and explain what happened. They'll assign your case to a “Claims Adjuster”. An Adjuster is the person who is responsible to investigate, and when appropriate pay claims filed against their insured.

She will ask to take your recorded statement. Give it. It is standard procedure, and will help move your claim along.

If you're having trouble understanding your rights and obligations arising from your injury it might be a good idea to contact a local and experienced Personal Injury Attorney. Most do not charge for an initial office consultation. At least you will know exactly where you stand, and what options you have.

In the interim you should continue treatment if it is still necessary. If not, collect all your medical bills, called “Hard Costs” together with any of your out of pocket expenses, and lost wages. Out of pocket expenses can include bandages, medicine, prescription, and over the counter medications. They can also include parking lot fees, and even an apportioned amount of gasoline used while treating.

The above is general information. Laws change frequently, and across jurisdictions. You should get a personalized case evaluation from an attorney licensed in your state. Find a local attorney to give you a free case review here, or call (888) 647-2490.

Best of luck,
