Liability for Car Accidents in Snow?

I have a fractured foot and bruised shoulder from a car accident I was in where I was the passenger. The driver lost control on black ice and hit a tree. I think the weather was responsible but the driver’s insurance should still pay for my injuries and treatment right?

Possibly. As the passenger, the driver’s insurance company would be responsible to pay your expenses.

Whether the insurance adjuster reviews your claim and accepts liability is questionable and depends solely on the policy.

If the policy allows liability for Acts of God (such as black ice, snow, rain, sleet, hail, snow), then most certainly your injuries and treatment should be covered by the drivers insurance. If, however such occurrences are not included, you may need to seek liability from the driver personally.
