Multiple Injuries After Getting T Boned by a Drunk Driver...

I was t-boned on the drivers side of my car by a drunk driver in Massachusetts. On impact I was knocked out and the air bags deployed. When I came to I was pinned in my car because his car had pushed the whole driver's side in, I suffered a panic attack at the time. I lost all feeling in my right arm and hand as I had put my arm out to shield my passenger.

Police, firetrucks and EMTs arrived on the scene. The other driver admitted he lost control of his vehicle, crossed the double yellow lines and slammed into me. The police smelled alcohol on his breath.

It took a while to free me from the vehicle and during this time I kept losing consciousness. At the hospital I had IV's and tons of tests run. The conclusion was that I had a concussion, cervical sprain, bruising to my chest and stomach from the seat belt, and loss of feeling due to trauma in my right arm and hand.

I've gone to physical therapy and have only improved to 45% mobility. I have also been diagnosed with PTSD (post traumatic stress disorder). I'm in constant pain and taking pain meds for this. I'm seeing doctors every other week. I am also on medication for the PTSD and panic attacks.

It's now 9 months later and I'm having to see a neurologist for an abnormality detected in my MRI and headaches.

I do have a lawyer but have not discussed settlement amounts. What would be a good starting point for my injuries and pain and suffering?

I have missed so much with my family from this and according to my doctors some injuries will cause me pain the rest of my life. Thank you for any advice you can give.

There is no doubt your automobile collision was of an extremely serious nature. Whether the at-fault driver was intoxicated shouldn’t affect your case. Whether he was intoxicated or not, he appears to be solely liable for your injuries.

From the facts you present it appears the at fault-driver “admitted he lost control of his vehicle, crossed the double yellow lines and slammed into me." If he was found to be intoxicated, he may not only lose his insurance, but his freedom as well.

Personally injury settlements are normally based on an extrapolation of a victim’s medical bills. The extrapolation is normally a multiple of 1x - 5x medical bills, or sometimes even more.

Because things like past, present, and future pain and suffering, lost wages, and out of pocket expenses are often impossible to determine with any degree of certainty, those items are made the basis of, and the reason for, the extrapolation.
