Visitor Question

Attorney didn’t pay the full amount owed to me?

Submitted By: Angely (Decatur, GA, USA)

I hired a personal injury attorney and based on our agreement he was supposed to pay us $3880. The check we received was only $3500. I have requested several times and explanation for the missing $380. He is not responding.

Can I report him for this? What to I need to do to get the remaining balance owed? Thanks.

Answer

Dear Angely,

Before becoming adversarial, take a look at the “Settlement Document.” The document should have been given to you by your attorney at the time the settlement funds were dispersed. The documents should explain in detail the amount and description of the funds subtracted by your attorney before you received your net settlement check.

If you aren’t satisfied with the explanation, then ask for a sit down meeting with your attorney.

He should be able to explain the details of the settlement and the reason the amounts were deducted.

If this fails, and you are sure you are right, you can always file a grievance (complaint) with the Georgia State bar, or consult with a legal malpractice attorney.

The above is general information. Laws change frequently, and across jurisdictions. You should get a personalized case evaluation from a licensed attorney. Find a local attorney to give you a free case review here , or call (888) 647-2490.

Best of luck,
