Burned at Salon School…

Submitted By: Bill (Las Vegas, NV)

My daughter burned herself while at salon school and had to leave. The owner said they are not responsible for anything.

My question is, I’m her father and a business owner (we have workers comp for our employees), doesn’t the owner of the salon school we are paying tuition to have any responsibility? Thank you.

Dear Bill,

It would seem the salon school should share some responsibility for your daughter’s injury. The next question becomes what your daughter’s injury amounts to. From the facts you present it appears your daughter didn’t require any medical attention. Absent medical bills there really isn’t a case.

You mentioned a burn. If the burn was severe enough to require medical attention the costs of that medical care should be presented to the salon. If your daughter acted negligently while at work and her negligence contributed to the burn, then sharing responsibility for the medical bills would seem appropriate.

If though your daughter clearly violated one of the salon’s directions and as a result was burned, the aspect of sharing responsibility with the salon would be lessened.

If your daughter’s burn was serious enough to require medical attention and the burn was a direct result of the salon’s negligence, your daughter should be compensated for her medical bills, any lost wages, her out-of-pocket expenses such as prescription or over the counter medicines, and possibly a small amount for her pain and suffering.

The above is general information. Laws change frequently, and across jurisdictions. You should get a personalized case evaluation from a licensed attorney. Find a local attorney to give you a free case review here , or call (888) 647-2490.

Best of luck,
