Can I File Personal Injury and Workers Comp Claims Together?

Submitted By: Rob (Concord, NC)

I was in my work truck at a stand still in a work zone. A lady hit me in the rear with her vehicle doing 60 mph. I’m wondering if I can collect from workers comp and the lady’s insurance company?

Dear Rob,

We will give you the attorneys answer – “Maybe”. What we mean is if you were “on the job” when you were hit, you should be able to collect from your Workmen’s Compensation insurance.

You may also pursue a separate settlement from the insurance company representing the at-fault driver.

The above is general information. Laws change frequently, and across jurisdictions. You should get a personalized case evaluation from a licensed attorney. Find a local attorney to give you a free case review here , or call (888) 647-2490.

Best of luck,
