Car Crash Damage Paid Privately?

Submitted By: Eileen (Chico, CA)

My neighbor hit my car while trying to park. He doesn’t want to go through his insurance company and asked to settle privately. I agreed and sought estimates. I asked him to pay me directly and I would handle the repairs. He then gave me a check payable to one of the repair companies.

Is he required to pay me directly? Or is it legal for him to pay the repair shop directly?

Answer

Dear Eileen,

Eileen:

As long as the money he paid, whether to you or to the repair shop, goes toward repairing your car, all is well and legal. There is no law prohibiting anyone from rightfully paying for damages they caused, especially when he is paying the money directly to one of the repair companies you chose.

The above is general information. Laws change frequently, and across jurisdictions. You should get a personalized case evaluation from a licensed attorney. Find a local attorney to give you a free case review here , or call (888) 647-2490.

Best of luck,
