Cesarian section stitches left a lump of skin sticking out…

I had a c section and the way that my incision was closed left a tag of skin that sticks out in the middle that looks really nasty. Do I have to live with this or is the doctor responsible for fixing it? Is this medical malpractice? What are my rights? I live in California. Thank you.

You are going to need a second, and maybe a third medical opinion to know whether or not medical malpractice occurred. The laws regarding medical malpractice in the State of California are similar to those in other states. Generally medical malpractice occurs when a doctor’s treatment of a patient falls, or “deviates” from the medical standard of care in the community.

Whether or not the existence of a skin tag, especially a “nasty” one, after a Caesarian Section falls within the medical standard for other doctors in the community, or general area in which the C-Section was performed must be addressed by other doctors.

If you can find one or more doctors who believe the skin tag was unnecessary and represented medical malpractice, you will have a good claim.
