Cut by Falling Ceiling Light…

I was standing at the return counter at a national home improvement store chain when a ceiling light fell and hit me. The light cut my calf and a piece of glass embedded itself into the skin. The laceration was about 1″ long and became infected. The home improvement store refused to provide medical care upon request.

I am a disabled person and feel my rights were violated. What can I do about this? Thanks for your response.

A lot will depend upon whether the ceiling light was one which fell from the store’s ceiling, or if the ceiling light was one which was being held by another customer. If the ceiling light fell from the top of the any of the home improvement store’s structures it would have to have fallen from about 100 feet above. That kind of a fall might have killed you or anyone else.

It is hard to understand why the national chain store refuses to assist you.

Go higher up the chain of command. If you can’t get anyone to agree to help, you always have the option of filing a lawsuit in Small Claims Court. In the State of Indiana the jurisdictional amount (maximum) amount a person can sue for is $2,000.00 dollars.

Before considering filing suit it will be important to have the medical bills ready to use as evidence.

Without medical bills you won’t have much of a case. The court will have to have something to base it’s decision upon; especially an amount to award in compensation for your injuries.

If there aren’t any medical bills, you can always just send a letter to the corporate office to explain to them what happened. Hopefully they will make sure it won’t happen to anyone else again.
