Cut Foot on Exposed Wire…

Submitted By: Mark (Ojai, CA)

I parked my truck in a the parking lot between a chain sandwich shop and a convenience store. There was I planter in between the two stores where I was walking through. There was a wire sticking out of the ground that’s apparently used to hold up new plants, but there was no plant there. I stepped on the wire and cut my foot pretty bad.

I didn’t go to the hospital and didn’t need stitches but it’s a bloody mess. I went inside the convenience store and told the manager about my injury. He went out and got the wire so the incident is on record. H also saw my foot which was bloody. Can I sue them for negligence?

Dear Mark,

To succeed in a personal injury claim you must have “damages.” They start with medical bills. Medical bills or dental bills are the foundation of every personal injury claim. If your foot injury required medical care, you might also be entitled to compensation for your out of pocket expenses for medications, lost wages, and for your pain and suffering. But unfortunately, without medical bills you won’t get very far.

It may not be too late. If there’s a chance the injury will leave a scar you may have the basis of a claim. It would start with a written medical prognosis from a plastic surgeon.

If you believe your injury is serious enough to require plastic surgery or other medical care, you may want to consult with a personal injury attorney. Plastic surgery cases are too serious and technical to be handled without expert legal counsel. Most personal injuries don’t charge for initial office consultations.

The above is general information. Laws change frequently, and across jurisdictions. You should get a personalized case evaluation from a licensed attorney. Find a local attorney to give you a free case review here , or call (888) 647-2490.

Best of luck,
