Do I have a Slip and Fall Case?

Submitted By: Anonymous (USA)

On a night out I fell down 2 unlit steps in a pub. I had

been drinking but I wasn’t that drunk. I have broke a bone in my right wrist. I’m wondering if I have a case and if it’s worth it to file a claim?

Dear Anonymous,

You never know until you file an incident report and a claim whether you have claim.

The best thing to do is find out the insurance information for the night club and give them all the information.

From there, they will either accept or deny liability. If they accept it, it may be minimized by your contribution to the fall (in states that follow this rule) due to your having had drinks.

Be advised that claims are based upon your medical bills so if you have not seen a doctor, the likelihood of settlement is slim to none. If you have seen a doctor, compile your bills since the adjuster will need these to evaluate your claim.

The above is general information. Laws change frequently, and across jurisdictions. You should get a personalized case evaluation from a licensed attorney. Find a local attorney to give you a free case review here , or call (888) 647-2490.

Best of luck,
