Eye Lashes Fell Out After Using Mascara…

Submitted By: Rebecca (Phoenix, Arizona)

I purchased a mascara on 12/24 and I applied the mascara on my top eye lashes only on 12/24 and 12/25. On 12/26, my eyelashes from the inner corner to mid lid were GONE and continued to fall out in clumps.

I went to an ophthalmologist and he confirmed it was a chemical reaction to the mascara. He referred me to a dermatologist to see if they can tell if the follicles were burned, if so they will never grow back.

This has been VERY traumatizing for me! I’m wondering if I deserve any compensation for this? Especially if my eye lashes will never grow back!

Answer

Dear Rebecca,

Certainly if your dermatologist’s prognosis is that your eyelashes will never grow back you have an excellent personal injury claim. If your prognosis is your eyelashes will eventually grow back you will still have a claim for your medical bills and out of pocket expenses, like prescription and over the counter medications.

You will also have a valid claim for any wages lost during your doctors’ visits, and a reasonable amount for the trauma (mental anguish) you suffered.

It’s important to be thoroughly checked and treated before going further. You must be sure there won’t be any lingering effects. Be especially sure your eyesight will not be damaged, nor will you have any permanent scarring.

In Arizona the statute of limitations for filing a personal injury clams is 2 years, so there’s no need to rush. Hopefully your eyelashes will grow back and your eyesight will not have been damaged.

The above is general information. Laws change frequently, and across jurisdictions. You should get a personalized case evaluation from a licensed attorney. Find a local attorney to give you a free case review here , or call (888) 647-2490.

Best of luck,

  1. Rebecca:

We’re so glad our information was helpful. Be sure to present the insurance company’s claims adjuster with the evidence you gathered.

You could have suffered permanent scarring. That in and of itself represents a real trauma.

Good luck with your claim. Let us know how things work out,

  2. Thank you for the response. I spoke with several attorneys but after reading through this website, I am pursing the claim myself. I have done everything step by step as suggested, notice of claim etc.

I couldn’t believe how quickly they responded and with a ridiculous amount of $200.00. I rejected the amount and now only dealing with the company’s insurance company. I’m not by any means going to get greedy, I’m using the formula to determine the amount I’m seeking.

Also my eyelashes have begun to grow back, SLOWLY but they are growing.
