Fell on ice going to a basketball game…

I was going to my son’s basketball game at his school and I slipped on a sheet of ice. The area where I fell was not lit and there was no evidence that the school had used any precautions to address the ice or warn of an ice hazard. I fell flat on my back.

What do I do? I notified the school, and the program sponsoring the basketball game. I have not yet gone to see a doctor, because I have no insurance. How can I get them to pay for me to go see a doctor? Thank you.

If you are injured you must seek medical care immediately, even if it requires you to go to the local hospital’s emergency room. Waiting to see if the school responds before seeking medical care may not only be injurious to your health, but for each day you wait to seek medical care, your credibility concerning the seriousness of your injuries diminishes.

Under the circumstances, the school is liable for your injuries and their resulting medical bills, out of pocket expenses, and even for your pain and suffering. Of course, all these items will be directly dependent upon the types of injuries you sustained.

The school, through its school administration, had a legal duty to make sure the school premises were safe, not only for you, but for other people legally in the premises. The school should have salted, or otherwise applied ice or melting chemicals to those areas where it is likely people would traverse.

The only exception would be if the school did everything reasonably possible to melt or otherwise remove the ice in a timely fashion, but because of the weather were physically unable to keep up with the constant freezing of the ground.
