Hit by a Bus While Crossing the Street…

Hi. I was crossing a street with the right of way and was hit by a transit bus making a left turn (on May 5, 2010). The bus driver started to drive off, but stopped when I chased after the bus, kicking everyone off and calling dispatch.

I waited on the bus with the driver for 10 minutes or so, in shock and concerned about a cut on my hand. The driver was increasingly hostile and I eventually told him I would get my own medical assistance and got off the bus.

I then went home and went to sleep and ended up not seeking immediate medical help. I couldn’t bear the headache I’d had since the incident a week later so I finally saw a doctor.

Ideally I would love to have the transit authority pay the resulting medical bill which is around $1,500. I requested the records from the bus company and they sent me the incident report and a recording of calls between the driver and dispatch. How should I proceed? Thanks.

You should ask the transit authority to pay your medical bills. It is difficult to understand though, why you waited a week to seek medical treatment.

If your hand was seriously cut and you waited a week before seeking medical treatment it is difficult to believe your medical bill was $1,500.00.

Unless you were admitted into the hospital immediately, or at least within a reasonable amount of time after you were cut, your case is weak at best.

Using a one day headache as an excuse for not seeking medical help for a week will not be helpful.

“Kicking” all of the passengers off the bus evokes thoughts of a person deranged. How you should proceed is to politely ask the bus company to reimburse you for your doctor’s visit.
