Hit by car while chasing dog…

Submitted By: Tanya (Lubbock, TX)

My dog recently got out of his collar and ran away. A lady was trying to chase him down and got hit by a car. She has been feeding him and has other dogs that he plays with, so he always goes to her. People are telling me that she plans on making a claim on me for her injury. I have not gotten anything from an attorney.

I am just trying to get ahead of the situation if this is true. This did not happen on my property. She never made me aware of the situation. What is my liability in this situation? She freely chose to chase after my dog, but did have a relationship with the dog. Does this mean anything? I’d appreciate any information you can provide.

Dear Tanya,

You have little to worry about. From the facts you present, the lady, albeit good hearted, made her own decision to chase after your dog. To be liable for a person’s injuries requires a showing of negligence. Learn more about the concept of negligence in personal injury claims here and here.

You exhibited no negligence before, during, or after the unfortunate event.

Although you state the lady was struck by a car, there was no mention of injuries. To be liable for a person’s injuries requires a showing of negligence AND proof of damages. Damages can be medical and/or therapy bills, out-of-pocket expenses, lost wages, or a combination of all three.

Without damages, even if you had been negligent, the lady would not be entitled to any compensation from you.

The above is general information. Laws change frequently, and across jurisdictions. You should get a personalized case evaluation from a licensed attorney. Find a local attorney to give you a free case review here , or call (888) 647-2490.

Best of luck,
