Hit by Trailer While Riding My Bike…

Submitted By: Robert (Dover , NH)

I was riding my mountain bike down the street when a FedEx truck took the corner too sharp causing his trailer to hit me and push me off my bike. I was thrown to the pavement and sustained abrasions, etc.

The driver took off so I jumped on my bike and caught him at the light. He apologized and said there was another car coming the other way and took off again. I wasn’t hurt real badly but could have easily been killed.

What kind of compensation should I be looking for? Shouldn’t something be done about the driver hitting me then driving away?

Dear Robert,

It looks as if something was done about it. The Fed Ex driver apologized.

If you had been seriously injured and he failed to stop he would have committed a crime called “Failure To Stop an Render Aid.” The fact you rode your bicycle and caught up to him at the traffic light is further indication of your condition.

He should have stopped. There is no doubt about that, but knowing Fed Ex drivers as we do, he was probably on a very tight schedule.

Your really shouldn’t be looking for any compensation, other than the cost of the band aids you may have used. We live in a litigious society. Too many people think if they are injured, even if slightly, there is a lawsuit out there just waiting to earn them lots of free money.

It doesn’t work that way. That’s one of the reasons prices for medical attention, food, and other tangibles keep rising.

People file frivolous lawsuits and the companies have to keep paying lawyers more and more money to defend them. Then insurance companies have to charge higher and higher premiums.

It’s a vicious cycle which represents one of the basics of inflation in our country.

If you want to get back at him, you can always call your local Fed Ex office and report him. Otherwise, be careful out there.

The above is general information. Laws change frequently, and across jurisdictions. You should get a personalized case evaluation from a licensed attorney. Find a local attorney to give you a free case review here , or call (888) 647-2490.

Best of luck,
