Hit in the Back in a Grocery Store…

Submitted By: Tony (Berkeley, CA)

I was in a grocery store and its employee hit me pretty hard in my back with a cart full of vegetables. It scraped the back of my heel to the point where it was bleeding. Now my back is starting to hurt and I don’t know if something serious could be wrong with it. I made a report with the grocery store and they admitted they are at fault.

Would this qualify as a personal injury lawsuit? What should I do about this to make sure I get taken care of, if there is a serious injury to my back? Thank you.

Dear Tony,

First see your doctor.

A personal injury legal action can’t survive without verifiable medical injuries. A cut to the back of your heel won’t be enough. Although we all hope your back is all right, you must see a doctor at your earliest convenience to see if you have suffered any type of back injury.

A doctor can order medical tests to determine the nature and scope of your injuries. The doctor can order an MRI (Magnetic Resonance Imaging) examination, or a CAT Scan (Computer Axial Tomography) examination. Both are helpful in determining anything from herniated disks to torn tendons and ligaments.

In the unfortunate event your back is seriously injured, the next step would be to contact the store again and tell them your incident in the store resulted in serious injuries. From there they will have their insurance company representative contact you. She will be the one with whom you will be able to negotiate your settlement.

Hopefully all will go well. If not, you can always consider the possibility of legal action.

The above is general information. Laws change frequently, and across jurisdictions. You should get a personalized case evaluation from a licensed attorney. Find a local attorney to give you a free case review here , or call (888) 647-2490.

Best of luck,
