Hit in the Head by a Cooler Door…

I walked into a store and opened a cooler. The metal cooler hinge was taped with scotch tape instead of screwed in like the others. It fell down and struck the right side of my head. It left a little cut (possibly will be a scar) and a knot, plus its been 4 days an the knot still hurts.

Do I have a case? And if so, what exact violations went on in this incident? Thank you.

The store appears to be liable in this case. There is no reason why they should have attempted to attach even a part of the cooler door by of all things, scotch tape.

Now that you know they are liable you can move to the next step in the process. That step will be your injuries.

The store owner will be responsible to compensate you for at least your medical bills, out of pocket expenses while being treated, and possibly the wages you may lose while receiving medical treatment.

The next step may be an impediment to recovery. Your case is only as good as the injuries you suffered. If you haven’t incurred any real medical bills, you probably don’t have much of a case.

Personal injury cases are almost always based on injuries and the attendant cost of medical treatment.
