How to value damage to my reproductive tract from a transvaginal mesh?

Submitted By: Anonymous (USA)

We all are probably tired of the ads on TV about problems with Transvaginal Mesh (TVM), but in my case the damages are real and unrelenting. In my case the medical damages, pain and suffering can be simply stated as the following:

-Vaginal stenosis -Vaginal spasm -Difficulty with fecal incontinence and pain while defecating -Multiple surgeries -Chronic pain (vulvodynia) -Loss of Consortium -Major Depression -Inability for gainful employment due to pain and depression

How should I value the damage (pain and suffering) from a vaginal mesh that has caused all these problems and that has destroyed my lower reproductive tract? Any information you can give would be greatly appreciated.

Answer

Dear Anonymous,

You yourself can’t value the pecuniary damage of your injuries. That should be the domain of a personal injury attorney with substantial experience in medical defective product and medical malpractice cases. These cases, including yours, are much too complicated for a layperson to handle on their own.

You may want to consider investigating whether there are any class actions which have been filed against the manufacturer.

Most personal injury attorneys will not charge for an initial office consultation. It would be in your best interest to consult with several. Be sure to bring copies of all your medical records, receipts for out of pocket expenses for medications, etc., and a written verification from your employer regarding any wages you may have lost as a result of your malady.

Attorneys have great leverage. They have the expertise to engage in pretrial discovery. They can subpoena records, take depositions, and when necessary, file a lawsuit. You can be confident a personal injury attorney will be able to settle your case for much more than you could on your own.

The above is general information. Laws change frequently, and across jurisdictions. You should get a personalized case evaluation from a licensed attorney. Find a local attorney to give you a free case review here , or call (888) 647-2490.

Best of luck,
