Visitor Question

Hurt While Shopping…

Submitted By: Ryan (Wichita, Kansas)

I went to a store to purchase two doghouses. They keep the doghouses outside. One of the women working at the counter informed me that they have to lift the dog house over the top of the fence to get it out because it won’t fit through the gate. We went outside to where they are located. She then instructed me to stand on the other side of the fence and then she will hand them over to me.

I stood where she told me, and waited for her to lift them over. As she hoisted one up and balanced it on the top of the fence I grabbed a hold of it and slowly it slid my way, then it came crashing down on me. Being twenty four years old and not wanting to look un-masculine in front of the female employee and my mom who came along with me, I tried to not let it bother me too much.

She then grabbed the second dog house and handed it over the fence and once again the house fell on me and really landed hard. When I got home I discovered a huge bruise on my leg and partially on my foot and toes. It’s been about a week and a half now, and the bruise has changed different colors and is now yellow and green, the bruise on my foot has faded.

I didn’t fill out an incident report immediately afterwards because of the immense pain. I just wanted to get home and get off my leg and foot, plus nothing like this has ever happened so I didn’t know the protocol.

Please inform me of what I can do, I am in incredible pain and don’t know what to do to. Thanks.

Answer

Dear Ryan,

Go to the nearest hospital or medical clinic. If you can have someone drive you there it would be better to go to the local hospital emergency room. There you will have access to x-rays and an MRI (Magnetic Resonance Imaging) examination.

Although having reported the incident at the time you were injured certainly would be quite helpful, you have your mother and the female employee as witnesses. It is doubtful the employee will deny the incident. She was only trying to do her job.

If the MRI and X-Rays are negative and don’t reveal any fractures, your injuries may be limited to the contusions to your leg and foot. Even the contusions can be dangerous. Left unattended there is always a remote chance of a blood clot forming. Although extreme, there have been cases of blood clots “letting loose” and traveling to the brain or heart. In the worst cases, strokes or death have occurred.

If, after being thoroughly checked at the emergency room you are discharged with a diagnosis of contusions and abrasions, the company where you purchased the dog houses would probably be liable for the emergency room medical bills and little else.

If for any reason, you have suffered fractures to your leg or foot the company may be liable for more than just the emergency room medical bills.

The above is general information. Laws change frequently, and across jurisdictions. You should get a personalized case evaluation from a licensed attorney. Find a local attorney to give you a free case review here , or call (888) 647-2490.

Best of luck,
