Improper Bathroom Tile Causes Slip and Fall Injury…

I was getting out of the shower and slipped on the floor, falling and injuring myself. I work in construction and I know that there is a difference between wall tile and floor tile. Tile meant for floors are non-skid, wall tiles are not.

When the landlord rebuilt the bathroom they put the floor tile on the wall and wall tile on the floor. Isn’t my landlord responsible for my injury in this case?

Dear Kevin,

Probably not; especially since you know about the difference in tile applications.

Unless you had moved into the residence within a matter of days from the fall and hadn’t had a chance to notice the difference in the tiles, the burden will probably fall on you as you had been taking showers there for weeks, if not months and:

A) Hadn’t noticed the difference; or

B) Did notice the difference and didn’t take precaution to mitigate a possible injury (that would have included putting a rug down on the tile because you knew the tile was dangerous before you stepped on it)

Under different circumstances where a person who wasn’t in the construction business and didn’t know the difference between the tiles and was injured, there is a good chance the landlord will be held accountable for his negligence.

Regrettably it is our opinion your landlord would not be liable for your injuries.
