Lawsuit Against the City for Car Crash Deaths…

My son and his friends all passed away in a car crash. The city came in and repaved street that the accident occurred on while the accident was still under investigation – clearly “hiding” or “covering up” the messed up streets because the streets/ intersection are uneven.

So there’s a lawsuit filed against the city and the city is asking our attorney for our educational background. Why is this relevant?

It is our policy not to interfere with the attorney-client relationship. Doing so is legally inappropriate. The relevance of your educational background may have something to do with the potential learning capacity of your son.

If the city’s insurance company is requesting your son’s educational background such information may be relevant. It goes to the earning capacity of your son.

The best thing you can do is sit down with your attorney. Ask her why she thinks the request for educational background is relevant. She may tell you the same thing we are. If there is another reason your attorney will explain it to you.

What your attorney is involved in is called “Pre-Trial Discovery”.

During this time both sides of a lawsuit are legally able to review any information they think is relative to the case. Whether that information will ultimately be admissible in court will strictly be up to the judge. Trust your attorney. She will undoubtedly do the right thing!
