Pit Bull Dog Attacks Child…

My child is 15 years old and was bitten by a pit bull back in January of this year. She was never seen in the emergency room or by any other doctors.

Can I file claim against the dog owner for trauma, pain and suffering of my child?

Carmen:

Although you are not prohibited from seeking compensation from the pit bull owner, your chances of recovery on your daughter’s behalf are minimal.

California has a 2 year Statute of Limitations (time you must file a lawsuit from the date of injury). Unless your daughter suffered scarring from the attack, or you will be able to present medical or psychological proof of her physical or mental injuries, you will again probably not recover any form of compensation.
