Premises and Operations Liability Questions…

I was at a well known restaurant/arcade chain playing one of the games. I grabbed the handle with my left and right hand and some metal wires were protruding out of the plastic coatings near the end of the handle. When I grabbed the handle the metal wires punctured into the middle of my hand.

I tried pulling the wires but couldn’t since it was deep and hurting my skin. I then shouted at an employee standing about 10 ft from where I was. He came and helped me remove the wires from my hand while I was still holding the handle.

Since then I have been having numbness on my right hand and I visited a doctor. The doctor said it will go away in time but it’s been 3 months already. What kind of case do i have?

Would this be product liability or personal injury against the restaurant or the game manufacturer?

I still have numbness on my right arm specifically forearm, wrist, hand and fingers from time to time. Thank you.

Liability, if any, would be against the restaurant owner under the premises liability theory. A property owner should inspect their property for known dangers and warn of them.

Here, the danger was that wires were protruding from a video game handle that is designed to be grasped by someone playing the game. Clearly the game was not regularly inspected. The only issue I can see, however is that it does not appear that you have sought regular treatment.

Settlements are based upon medical bills incurred in a given case. If you have not received regular treatment, any settlement would be minimal.
