Question about knee injuries and workers comp…

Submitted By: Ben (Burlington, WI, USA)

I fell at work. I work in the meat dept of a grocery store in Burlington, WI. The whole back room needs to be hosed down when cleaning. We have two drains with no special grips to prevent accidents plus there was no “Caution – Wet Floor” sign either.

I now need to have surgery on my right knee. I broke my Meniscus and the down time is about 4 to 6 months easily with physical therapy after surgery. I have already applied for a hearing. I’ll send all of the paper work in after surgery and while taking physical therapy to recover.

Is there anything else I can do?

Dear Ben,

Breaking the Meniscus is so very painful. We hope your recovery is swift. From the facts you present you have taken the correct action so far. It’s very important you be prepared for the eventual hearing. There is an expression some of the more successful attorneys use. It is: “The person (attorney) with the better knowledge of the facts and the law will prevail 9 time out of 10 times.” And that applies for just about every case, civil and criminal.

So if you have studied everything there is to study about Meniscus injuries, including the rate of success for surgeries, times of recovery and future limitations, to name just a few, then you will have as good a chance as anyone prevailing at your initial hearing without having to go through an exhausting and lengthy appellate process.

The above is general information. Laws change frequently, and across jurisdictions. You should get a personalized case evaluation from a licensed attorney. Find a local attorney to give you a free case review here , or call (888) 647-2490.

Best of luck,
