Slipped and Fell in a Restaurant…

Submitted By: Aidiam (Texas)

I slipped and fell down in a public restaurant and now I hurt all over. The reason I fell was because there was some food on the floor and I slipped on it. I talked to the manager right away but she didn’t do anything about it. Is there anything I can do?

Answer

Dear Aidiam,

Your immediate health is paramount. If the fall caused any medical problems you should seek a physician’s care before considering any legal action. To prevail in such an action or lawsuit against the restaurant you must first prove your “actual damages.”

Actual damages are items such as emergency room bills, hospital bills, medical bills, the costs of medical narratives, out of pocket costs such as prescription medications, bandages, and even physicians’ or hospital parking lot costs.

A Physician’s Diagnosis of your injuries and her Prognosis for your future will also become integral parts of your claim. The combination of all of these items should result in an agreed or court ordered judgment in your favor.

The above is general information. Laws change frequently, and across jurisdictions. You should get a personalized case evaluation from a licensed attorney.
