Slipped on Broken Eggs in Grocery Store…

I was walking down an isle in a grocery store, walking at a regular pace, when I all but slipped but caught myself. I realized after a bit that someone prior had dropped raw eggs on the floor. Someone must have picked up the shells but left the remaining egg on the floor. I badly injured my ankle when I caught myself from falling.

I immediately notified the manager they took an incident report. I then made a doctors appointment and got x-rays. The doctor said my ankle was badly sprained and bruised. The doctor is now recommending that I see an orthopedist because of the bad sprain. I didn’t have any broken bones, just a bad sprain and bruise.

The store checked cameras and saw the cracked eggs on the floor. They admitted that usually employees check floors for spills etc, but failed to do so in that instance. The store is having me sign release forms from my doctor for the medical documentation of my injuries.

You can’t place a value on your case just yet. You must first follow through with your medical treatment. Your injuries do not sound serious, sprains and bruises are considered “soft tissue” injuries.

Although premature, if you want to place a value on your case now, your case will be worth about 1 1/2 to 2 times your medical bills. That may not seem like much, but that’s the way insurance companies operate.

If in the event the orthopedist finds any more serious injuries, like a fracture, your case will be worth more.

Fractures and similar serious, or “threshold injuries”, are worth much more than soft tissue injuries.

The insurance company will want to know why, after your primary doctor diagnosed your injury as only sprains and bruises, he referred you to an orthopedic surgeon.

Unless you have a good reason your case won’t go much further than the extent of your medical treatment and resultant costs. In addition, if you had to miss work as a result of your injury or subsequent treatment you may be eligible to receive compensation for your lost wages.
