Sprained Ankle After Stepping in a Sinkhole…

Submitted By: Pam (Sacramento, CA )

I fell in a sinkhole at a mobile home park and sprained my ankle. Now the park is saying they are not at fault, however they are willing to pay my $2,218 medical bill and give me $500 for pain and suffering.

I do not feel $500 is enough. Am I due more compensation? Should I negotiate with them or take them to court?

Dear Pam,

Considering the facts, a total settlement of $2,518.00 for a sprained ankle is quite good, even if the compensation for pain and suffering is $500.00 dollars. Incurring over $2,000.00 dollars in medical bills for a sprained ankle seems excessive. If that amount includes an ambulance ride, emergency room treatment and follow up medical treatment that amount might be reasonable.

In addition, compensation for pain and suffering is usually paid only when there is some malevolent behavior by the person or entity causing the injury. In this case that behavior does not seem to be present.

In all, it seems you have fared well with your settlement. Filing a lawsuit in this case does not appear necessary.

The above is general information. Laws change frequently, and across jurisdictions. You should get a personalized case evaluation from a licensed attorney. Find a local attorney to give you a free case review here , or call (888) 647-2490.

Best of luck,
