Truck Smashed My Knee at a Lumber Yard…

Submitted By: Dave (Russellville, AR)

I was at a lumber yard returning material in the back. I was unstrapping the load when I got a feeling I should turn around. A pickup truck was backing up right then and pinned my leg between his bumper and my trailer.

I needed to have work done on my knee due to the injury. I still have pain and some nerve damage. Now I’m waiting for a nerve condition study to be done. I was told that the lumber yard could also be held responsible for this, due to not keeping things under control.

How do I know who’s responsible and get fairly compensated? Thanks.

Dear Dave,

There may be several parties who share liability for your injuries. They appear to be:

-The pickup truck owner

-The pickup truck driver (if different from owner)

-The owner of the lumber yard

Many personal injury claims can be handled without an attorney. They include claims for “soft tissue” injuries such as swollen muscles, tendons or ligaments, abrasions, cuts and bruises, and other non-serious injuries.

According to the facts you present, you may have suffered nerve damage. That is considered a “hard injury.” Hard injuries demand higher compensation. Most hard injury claims are best served when a personal injury attorney becomes involved.

Speak with a personal injury attorney. Most won’t charge any fee for an initial office consultation. The attorney will be able to give you a better idea of what she believes your claim is worth, and if she believes her representation will result in a net amount of compensation to you higher than that you would be able to recover on your own.

The above is general information. Laws change frequently, and across jurisdictions. You should get a personalized case evaluation from a licensed attorney. Find a local attorney to give you a free case review here , or call (888) 647-2490.

Best of luck,
