Wheelchair Accident on Handicap Bus…

My son is handicapped and confined to a wheelchair. We used a handicapped bus to take us into town and took the same bus home. After my son was unstrapped from the safety equipment I got off bus first, but by the time I was down the ramp and about to turn around I heard my son son yell.

The driver somehow dumped him out of the wheelchair onto the bus floor where he hit his paralyzed weak side and head, causing him to start bleeding. They got him up and back in the wheelchair and I called 911. EMS came to check him out but he refused to go to the hospital.

A few days later he started to complain about his knee hurting and having a headache. The bus company has him not being able to ride the bus until he gets new wheelchair. I’d like to know if he has a personal injury case?

Your son does have a personal injury case against the bus company. The question though is how much money will be involved in a case like your son’s.

Hopefully your son’s injuries aren’t too serious.

You didn’t make clear the reason the bus company is compelling you to purchase a new wheelchair for your son.

Certainly if the fall in the bus caused your son’s wheelchair to be damaged, the bus company should at a minimum pay for a new wheelchair.

It would be a good idea to add up your medical bills to date. If your son’s injuries are such that he will require additional medical assistance be sure to make those amounts known to the bus company or their insurance representative.

Contact the bus company and tell them you want to file a claim. Hopefully they will refer you to their insurance company.

Once they do

you will be on the right path toward resolving your son’s case.

In the event the bus company doesn’t cooperate you may have to consider legal action.
