Rear-Ended Car Accident Needing Chiropractor Treatment...

by Anonymous

We are a family of four and our car was rear-ended on our way to our vacation. The other driver was at fault. My husband, I and our two children, 14 & 8 all went to see a chiropractor. After the x-rays were taken, my neck was the most severe.

As of yesterday, my total chiropractor bill is $810. My husband's was $800 and the kids totaled $690 each, but we're not done with the treatment yet. We haven't done the estimate for our car yet. My husband missed 3 days of work. I missed a full day of a catering job.

Aside from the medical bills, how much compensation is fair for the whole family for all the trouble caused by this accident?

Thanks so much for your help!

ANSWER for "Rear-Ended Car Accident Needing Chiropractor Treatment...":

You and your family will submit separate settlements for each of you. This is because your degree and length of treatment may vary and each of you may settle at different times.

But before settlement, you want to definitely finish treatment because what you ultimately settle for is based upon your total bills. Once you complete your treatment, you will take your total medical bills and multiply that figure by 2-3. (For example: $800 x 2 = $1600 and x 3 = $2400.00).

This will give you a rough idea of your settlement range. To that, you will want to add lost wages, out of pocket expenses (such as prescriptions) and submit that as a settlement demand to the insurance company.

The above is general information. Laws change frequently, and across jurisdictions. You should get a personalized case evaluation from an attorney licensed in your state. Find a local attorney to give you a free case review here, or call (888) 647-2490.
