Rear-Ended in a Taxi Cab...

by Peter
(Boston, MA, USA)

I was parked at a taxi stand in my leased taxi cab. A car, for a reason I don't know, hit me. The cab had enough damage to be totaled. I have physical therapy ongoing for shoulder, back and neck pain. I drove myself to a hospital for the 'soft tissue injuries'. Would you be able to tell me how much this Massachusetts case is worth?

ANSWER for "Rear-Ended in a Taxi Cab...":

First and foremost, I would need to know your status as a cab driver: Are you an independent contractor or an employee? That determines whether it is a personal injury case or a workers compensation case.

I assume from the fact that you were "leasing" the cab that you are independent. From there, settlements are derived from a few factors. It is important to address the fact that the cab was totaled. In addition, your total medical records once you complete treatment will factor into the bottom line settlement figure. Lastly, you will need to be able to articulate but also SUPPORT your claim for lost wages and out-of-pocket expenses.

It is a bit more difficult for self-employed individuals to substantiate their income, but still possible especially if you receive a check. Attorneys will use these various items to put a demand letter together. As a general rule of thumb, you can multiply your medical bills by 2 or 3 and to that, add your lost wages and out-of-pocket expenses.

The above is general information. Laws change frequently, and across jurisdictions. You should get a personalized case evaluation from an attorney licensed in your state. Find a local attorney to give you a free case review here, or call (888) 647-2490.

Best of luck,
