Refused x-rays while pregnant...
(Fairview Heights, IL)
I am currently pregnant and I was in a car wreck 2 days ago. The baby is fine but I also had to have them look at my knees because I seem to be incapacitated. Both of my knees have extremely obvious contusing. I can stand on my left knee pretty well even though there's still a substantial amount of pain, but my right knee can not take any pressure at all.
I refused to take x-rays because of the possible risks to my unborn baby. In other words, I refused to sign the form saying that I allow my baby to be hurt. So the ER sent me home with just a simple wrap and told me to go ahead and return to work.
I really do not believe I will be able to return to work and now I may lose my job. Just because I refused to consent to hurting my child doesn't mean there isn't something wrong, but I guess that's how they took it.
Shouldn't I at least have been given more time off to see if the right knee even heals like the left? And isn't there something else that could have been done for me? Can anything be done about this situation? Thanks.

ANSWER for "Refused x-rays while pregnant...":
Jessica (Fairview Heights, IL):
You are in a precarious position. It's certainly understandable you want to be as protective as possible about any harm the radiation might pose. On the other hand, there must be some substantiation of your knee injuries for your employer or the workers compensation insurance company to allow you to take off while receiving benefits.
You must discuss this matter with your supervisor. Certainly she may be able to intervene and secure permission for you to take some time off. Additionally, you may be able to find another physician who can diagnosis your knee injury without the use of x-rays. As long as you have a diagnosis from a licensed physician you should be able to receive some time off until your injuries heal.
Finally, depending upon the nature of your pregnancy, you may be able to ask your OBGYN to examine you. If she is willing to support your inability to work you may be able to use that diagnosis as well.
The above is general information. Laws change frequently, and across jurisdictions. You should get a personalized case evaluation from an attorney licensed in your state. Find a local attorney to give you a free case review here, or call (888) 647-2490.
