Slip and Fall Injury Causes Hearing Loss...

by Lucy

On May 30, 2008 I walked into the dialysis center I normally go to and didn't see the water on the floor. I slipped and went down so quickly (didn't see it coming).

I hit the left side of my face on a concrete sink, causing a lot of bruising & swelling. It also triggered vertigo with loss of hearing. I've needed long term care to "try" to restore my hearing. If it can't be restored, then surgery is the next option to insert a tube in my eardrum.

I'm trying to inquire what is a "fair" settlement for this kind of injury with hearing loss? I'm aware that it's somewhat difficult to win a fair settlement for "soft" tissue injuries.

ANSWER for "Slip and Fall Injury Causes Hearing Loss...":

Lucy (FL):

Loss of hearing is not a soft tissue injury. Whether the hearing loss can eventually be restored does not change the fact that the injury was not soft tissue.

It is difficult to assess a fair settlement without more information. Knowing the costs of medical treatment is a very important factor in determining settlement amounts.

You may be entitled to additional compensation for lost wages and out of pocket expenses such as medicines, compresses, and other necessary items.

Finally, your settlement should include additional amounts for “Pain and Suffering” Pain and Suffering refers to the pain, anxiety, stress and other adverse effects caused by the trauma. The compensation is related to all you have suffered and continue to suffer.

The above is general information. Laws change frequently, and across jurisdictions. You should get a personalized case evaluation from an attorney licensed in your state. Find a local attorney to give you a free case review here, or call (888) 647-2490.

Best of luck,
