I was hit by an 18 wheeler. It was a commercial policy. The insurance adjuster accepted fault and paid the property damages. However, the PIP is taking forever to get paid on.
I have an attorney who is supposedly working this for me but they fail to return my calls. It seems I keep getting the complete run around from them.
My accident was 5/28/11 and it is now 11/16/11! How long should this whole process take? I was treated by my doctor and released. I was told so many different things from different people. Please let me know what you think. Thanks.

PIP payments usually don’t take 6 months or more. Unless there are other factors involved in your case, 6 months is a long period of time to have to wait to be paid for your personal property damage.
If you were injured in the collision and your attorney is still working on the liability issues in your case, that may have something to do with the hold up on your PIP.
The best thing to do is sit down with your attorney. Ask to review your file. Do it in person in your attorney’s office. A telephone conversation with your attorney won’t be as productive as the in office consultation. The only way you will know for sure why your PIP is taking so long is to ask your attorney.
You either trust her or you don’t.
If you don’t have confidence in your attorney you always have the right to dismiss her and retain new counsel.
Just remember if you do your original attorney will most likely retain a lien on your settlement. That lien is a strong and definite barrier from having another attorney undertake your representation.
