Whiplash Injury Claim with Back Spasm
I was struck about 7 months ago from a car driving behind me. I attended physio twice a week for about 5 months. I had whiplash and severe muscle spasm in my back.
My first offer was $9,000. I wanted somewhere around $1,200, I asked for $1,500, how much more can they offer if there first offer was $9,000?

ANSWER for "Whiplash Injury Claim with Back Spasm":
An offer from an insurance company is based upon certain factors such as your medical bills, out of pocket expenses and lost wages. Typically the insurance company does not offer their final figure straight away so if they have started at $9,000.00, my guess is that there is more money available to you.
As a general rule of thumb, settlements are 2.5 to three times your medical bills plus out-of-pocket expenses and lost wages.
Without knowing your total medical bills, its hard to say whether this settlement figure is fair under the circumstances, however if you use that little formula, you will be able to gauge how much money is potentially on the table.
The above is general information. Laws change frequently, and across jurisdictions. You should get a personalized case evaluation from an attorney licensed in your state. Find a local attorney to give you a free case review here, or call (888) 647-2490.
