Can I be compensated for laser treatment and/or plastic surgery?

Submitted By: Anonymous (California)

I got bit in the face by someone’s dog while lawfully on their property. I received 4-5 stitches above my lip. The dog took a small piece of my lip and the other lacerations will leave a couple of scars. Since this just happened I don’t know what it will look like after it heals.

The ER doctor who gave the stitches said it will take a year to know, but said there will be some scars.

Can I be compensated for any laser treatments or possible plastic surgery to get it back to the way it looked before? Will an attorney take my case if the scars aren’t huge? The bite was bad and painful with swelling and bleeding. I have pictures of my wound and they look very bad. I live in California. Thank you.

Dear Anonymous,

From the information you present, it appears you have a legal right to seek compensation against the dog owner. If you were injured on a residential property, the homeowner’s insurance should cover your damages.

Hopefully, the dog owner will cooperate. Even if the dog owner isn’t the homeowner, the homeowner will share liability with the dog owner. If the dog owner and homeowner are two different people you are legally entitled to pursue a personal injury claim against both.

Even if the dog owner is not the homeowner, the dog owner’s own homeowners policy may cover your damages.

You have a right to be compensated for your medical and therapy bills, your out of pocket expenses such as prescription and over the counter medications, medical facility parking lot fees, and even a prorated amount for the gasoline you use going and coming from your treatment. Finally, you have a right to be compensated for your pain and suffering.

You should really seek the advice and counsel of a personal injury attorney immediately. Most won’t charge for an initial office consultation. You seem to have a solid case. The attorney may want to file a claim immediately, but come to an agreement with the insurance company to wait at least a year before finalizing the claim.

Check with your state’s statute of limitations period. Depending upon which state the injury occurred

you may have anywhere from 1 to 3 years to settle your claim or file a lawsuit.
