My sister, a friend and I were leaving a grocery store. We each had carts.
We saw 2 cars with reverse lights on in the handicap spots, so we waited, neither of the drivers moved, so we proceeded.
We got to my sister’s truck which was about 5 spaces up and across from the driver sitting, which was on our left as we walked. My sister began to put her groceries in her truck. My friend and I said goodbye and my car was parked about 2 more spaces up and across from my sister’s truck.
We looked, it was clear and we started walking up the lot to my car. Before we could get there, My friend was 2 steps in front of me. He looked back at me to say something and he yelled NO,NO, wait wait! I turned around, hands still on my cart and BAM! She hit me so hard, my cart flew, my groceries were thrown from the cart and I hit the ground so hard that my knee cap was knocked out of place.
When I was able to sit up, because I couldn’t get up, we realized it was the driver that we had seen in the handicapped space at least 7 spaces down the lot. We never saw her pull out but she was straight when she hit me. It was almost as if she forgot to put the car in drive after she pulled out of the space and hit the gas in reverse.
I’ve missed work, I’m not able to go care for my mother as I normally do, as I am still healing, I still have to see an orthopedic doctor and my knee is still very swollen and I am in constant pain.
My job requires me to sit and key information so I have to stop working, get up stretch my leg or it won’t move. I have obtained a lawyer but I would like to know what kind of settlement I should expect and if I actually need a lawyer to get it.

Put simply: You do not need a lawyer for any case, however there are some cases for which having a lawyer might make settlement a lot easier.
In this case, liability should not be disputed.
Pedestrians have the right of way and you were hit while walking through a parking lot. What an attorney can do however is get a higher settlement for you because they are typically well versed in the language and laws that must be articulated in order to get the most for your case.
Be advised however, that you will need to pay at least 33% of your settlement to your attorney for their expertise. In terms of what the settlement is worth, this is based upon your medical bills.
Usually, you can take your medical bills and multiply them by 4-5 as a baseline to start your settlement. For example if your medical bills are $2,000, you can demand $8-10,000. If you have an attorney, you can likely trust their judgment on settlement.
