I was getting on an elevator when all of a sudden my foot slipped I fell and hit my head. I suffered a concussion with whiplash and minor memory loss. It’s been 3.5 months. I’ve been suffering from headaches, neck pain, dizziness concentration problems, etc.
I have not been able to work. I am seeing a chiropractor for my neck and back pain but the headaches and a whole bunch of symptoms are still present. I am on medication for the swelling of the brain but the headaches are persisting. Had CAT scan done, the result was negative for bleeding in the head.
I did fill out an incident report and the insurance company has it on file. Please help me determine my rights. Thanks.

There are 2 parts to bringing a personal injury case – liability (fault) and damages (injuries).
In this matter, liability is the issue. What was the “defect” that caused your fall?
You need to be able to prove that the building owner/tenant either did something wrong or failed to do something they should have done.
If it was some coffee that the person in front of you spilled, then you don’t have a case. If it was a janitor who was mopping and failed to put out a caution sign or if it was a rainy day and the building did not put out extra rugs at the entrance, then you probably have a case.
