My wife and I were rear ended while at a red light on Nov, 28 2011. The driver was said to be DUI/DWI (Driving Under the Influence / Driving While Intoxicated). My truck was totaled out by the at-fault driver’s insurance company.
My wife and I suffered injuries and we go to the chiropractor for treatment. Neither of us had to get in the ambulance or go to the emergency room. We have been going to the chiropractor for about 2 months, 3 times a week.
I would like to know (approximately) how much my case is worth? Can you give us an idea? Thanks.

It depends. That’s to say personal injury cases are based on what are referred to as “damages”. Damages can include, but are not limited to: medical and chiropractic bills, out of pocket expenses such as prescription and over the counter medications, lost wages while treating and recovering, and an additional amount for pain and suffering.
Personal injury cases are often settled first and primarily based upon a multiple of the amount of medical bills. That multiple, usually 1.5x to about 3x for cases like yours, is meant to “absorb” the medical bills, chiropractor’s bills, out of pocket expenses, lost wages and pain and suffering. Doing so enables the insurance company to cover all “bases” at one time and with one settlement offer.
Unfortunately you and your wife don’t appear to have any medical expenses, and seem to be relying entirely upon chiropractic treatment. Insurance companies do not afford chiropractors the credibility or legitimacy they do medical doctors.
As a result you may be disappointed to learn your settlement offer, if any, may only be enough to cover some, not all of your chiropractor’s bills.
The above is general information. Laws change frequently, and across jurisdictions. You should get a personalized case evaluation from a licensed attorney. Find a local attorney to give you a free case review here , or call (888) 647-2490.
